Global Corporate Takeover is Here and No One Seems to Notice

By SmokinJoeTrainer

While you're fighting with your neighbors about flags, racism and class, your country is being hijacked. What do you call it when a foreign entity takes over your nation's policy on food, medicine, taxation, and internet freedom? All this done in semi-secret by bribed politicians and false flags to distract the masses.

Senator warns of another attempt to pass Obamatrade

ummm . . . this is NAFTA & GATT 2.0 and the door for absolute World Government which is already in effect, but not completely. . and the Republicans are all for it , as well as Obama . . and you, nor the Congress are really "allowed" to see what is in the bill . . sounds great, eh?  . . but, since there are so many Republicans for it, there will be many who will assume that it's a good bill, you know, for the economy . .  and that the evil Democrats blocked it . . and vice-versa . .

WND EXCLUSIVE

Preparing 'to force through new executive powers' for Obama

June 13th, 2015 - Art Moore

House Democrats led the charge Friday to kill a bill that has stalled President Obama’s trade agenda, but a leading Republican opponent in the Senate warns congressional leaders are preparing next week “to force through new executive powers for President Obama.”

In a stunning 302-126 defeat, the House killed a worker-aid bill – Trade Adjustment Assistance – tied to legislation that would give Obama “fast-track” authority to negotiate and expedite the passage of trade deals with minimal congressional involvement.

jeff-sessions

Sen. Jeff Sessions, R-Ala., said in remarks provided to WND that a vote for TAA next week “is a vote to send fast-track to the president’s desk and to grant him these broad new executive authorities.”

“If that happens, it will empower the president to form a Pacific Union encompassing 40 percent of the world’s economy and 12 nations – each with one equal vote,” he said.

Sessions was referring to the Trans-Pacific Partnership, one of the three major trade agreements under negotiation that Obama wants to approve with fast-track authority, known officially as Trade Promotion Authority, or TPA. Under TPA, no amendments would be allowed and the trade deal would be approved on a simple up-or-down vote.

The House held a symbolic vote Friday in which fast-track authority was approved, 219-211. But according to rules approved by the Senate, the legislation cannot advance unless the House approves both TAA and TPA. Trade Adjustment assistance provides job training and financial aid to workers who lose their jobs as a result of foreign-trade agreements like TPP.

Obama’s trade agenda is opposed by a large majority of Democrats, some tea party Republicans, labor unions, environmental groups and Internet-freedom advocates. Supporters include Republican leadership and corporate lobbyists with the U.S. Chamber of Commerce.

As WND reported, Sessions asked Obama last week to explain why the draft text of the Trans-Pacific Partnership should not be made public before Congress considers the legislation that would pave the way for the trade deal’s approval.

He was particularly concerned about a section of the TPP that creates a new transnational governance structure known as the Trans-Pacific Partnership Commission. Sessions said the details of the new body are “extremely broad and have the earmarks of a nascent European Union.”

The commission – chartered with a ‘Living Agreement’ clause – would have the authority, he said, to amend the agreement after its adoption, to add new members and to issue regulations impacting labor, immigration, environmental and commercial policy.

“Once the union is formed, foreign bureaucrats will be required to meet regularly to write the commission’s rules, regulations and directives –impacting Americans’ jobs, wages and sovereignty,” Sessions said.

The senator explained that fast-track authority will apply not only to the TPP but “can expedite an unlimited number of yet-unseen international compacts for six years.”

One is the Trade in Services Agreement, or TISA, which provides for labor mobility among more than 50 nations, “further eroding the ability of the American people to control their own affairs,” Sessions said.

‘Procedural snafu’

Minutes before the TAA vote Friday, the House’s top Democrat, Minority Leader Nancy Pelosi, took to the floor to appeal for a “better deal” for American workers.

The White House downplayed the outcome Friday, with Press Secretary Josh Earnest calling the vote a “procedural snafu.”

He said he hoped a bipartisan majority could eventually be reached.

“These kinds of entanglements are endemic to the House of Representatives,” Earnest said.

Sessions said, however, that “Americans do not want this, did not ask for it, and are pleading from their hearts for their lawmakers to stop it.”

In a statement, President Obama called on the House to reconsider the Trade Adjustment Assistance bill.

He said the House’s “inaction will directly hurt about 100,000 workers and their communities annually if those members of Congress don’t reconsider.”

Obama said his “top priority as president is to grow the economy and open new avenues of opportunity for hardworking Americans.”

He argued “smart new trade agreements” will “encourage new sources of growth and job creation, so that America remains vital, dynamic, and on the cutting edge” and “to stand in their way is to do nothing but preserve the long-term status quo for American workers, and make it even harder for them to succeed.”

Republican opposition to Obamatrade

A group of conservative House members played a role in stopping Obamatrade, at least for now.
While Democrats opposed TAA because they wanted to expand federal assistance to public sector workers, Rep. Jim Jordan, R-Ohio, spoke for a faction in the House who wanted to see the provision eliminated entirely, remarking to WND on Monday, “Why are billions of dollars for a social-welfare program part of trade deal?”

Rep. Jim Jordan, R-Ohio
“If you believe in trade,” he continued, “then you don’t need a social welfare system saying that the jobs are going to be lost. We believe trade creates jobs. If you believe that, why do you have a social welfare giveaway as part of the deal?”

Jordan worked closely with a group of conservatives who support free trade but had three problems with TPA, one of which was TAA.

Another was the exclusion of Congress from the negotiating process, which could be fixed, he said, by an amendment drafted by Reps. Rick Mulvaney, R-S.C., and Mark Meadows, R-N.C., that would let the entire House, not just the 37 members of the House Ways and Means committee, vote on any changes to the bill that would give the president the fast-track authority to make trade deals.

Jordan said the third problem was,”We think the TPA bill is now linked, in an indirect way, to the Export-Import Bank.” He and like-minded conservatives want to let authorization for the Export-Import Bank expire at the end of the month.

“If we’re going to stop this huge corporate welfare program, we’ve got to make sure the bill doesn’t get to the floor.”

After the Friday votes Jordan said, “Conservatives in Congress support free trade,” and that he and his colleagues “still are willing to work with our leadership to make this legislation better.’
“Our leadership tried to compromise with Democrats instead of us, and now we know that strategy failed,” he said. “We stand ready to work on free trade legislation that is both transparent and consistent with Republican principles.”

Republican support for Obamatrade

Obamatrade supporter, Rep. Pete Sessions, R-Texas, chairman of the House Rules Committee, said House Democrats “chose today to take down their own worker protection program, a policy they have strongly supported for nearly 50 years.”

“Because of this, our work on this issue is not over, but I am proud of the work my colleagues have done to pass TPA, and I look forward to using the tools at the House’s disposal to get this important measure to the president’s desk,” he said.

Opponents of Obamatrade say they oppose TPA because it would give too much power to a president they don’t trust.

But Rep. Sessions used that very point to argue for its passage, saying, “I supported TPA today because I do not trust this president.”

“President Obama has overstepped his constitutional authoity many times, which is precisely why taking up the TPA language was so important,” he said.

The Texas congressman explained the president “already possesses inherent authority to negotiate trade agreements with other countries on his own.”

“This means that without TPA, Congress and the American people would have been stuck on the sidelines,” he argued. “Today’s passage of the TPA portion of the bill proves we can look forward to another century led by American values, principles, practices and successes when it comes to trade.”
Rep. Sessions pointed out he worked with Rep. Steve King, R-Iowa, to incorporate language in the TPA that would ensure no trade deals require changes to current immigration law.

“With this language, this president – or any future president – will not be able to take yet another good bill and use it as an opportunity to insert his unlawful, unwise and unconstitutional amnesty agenda,” he said. “It also includes safeguards against changes to current law in the areas of climate change, currency and American sovereignty.”

Sen. Jeff Sessions of Alabama, however, argues the “same people projecting the benefits of leaping into a colossal new economic union could not even accurately predict the impact of a standalone agreement with South Korea.”

The deal with Seoul, he pointed out, promised to boost U.S. exports to South Korea $10 billion. Instead, the increase was less than $1 billion, while South Korea’s imports to the U.S. increased more than $12 billion, nearly doubling the trading deficit.

The TPP, he said, “will only further increase our trading deficit: opening our markets to foreign imports while allowing our trading partners to continue their non-tariff barriers that close their markets to ours.”

Sen. Sessions said that if the U.S. wants a new trade deal with Japan or Vietnam, it should be negotiated bilaterally and sent to Congress under regular order.

“Under no circumstances should the House authorize, through fast-track, the formation of a new international commission that will regulate not only trade, but immigration, labor, environmental, and all manner of commercial policy,” he said.

“What American went to the polls in 2014 to vote for fast-track and a new global union?” he asked. “Can anyone honestly say that Congress is trying to ram this deal through because they think their constituents want it?”

Do the TIPP and TPP Treaties Signal the Rise of the One World Government?

Connecting The Pieces

Jay Johnson

In his book, Confessions of an Economic Hit Man, John Perkins pulls back the curtain to reveal how exactly the globalization machinery works. The signing of the TTIP and TPP treaties create the framework for a one world government.

Gone are the days of freedom and democracy as the American oligarchy have created the conditions for the rise of worldwide corporatocracy.

According to some academics, the world is in the third stage of globalization. In a lecture presented at Auburn University, the first stage of globalization was the discovery and subsequent colonization of foreign lands, mostly by Europeans in the 1400s and continuing forward. The second stage occurred somewhere after the invention of the steam engine and the railroads. The third stage began after the marriage of cheap computers and public internet, somewhere in the mid 1990s. With this in mind, as globalization has progressed, a similar trend has been occurring simultaneously in the political/business world.

As people slowly changed from recognizing and fighting for local principalities, to the rise of the nation state and now to the supranational state via the creation of monetary unions like the EU or military blocs, such as NATO, the net effect is that borders have been destroyed and once distinct cultures have merged or are merging.

Everything everywhere is slowing becoming homogenized and standardized. Want to watch the new Avengers movie? It’s coming soon to a movie theater to you! (in a language you speak) Thirsty? Have a Coke! (it’s sold in the same standardized units worldwide) Need some military training or weapons? America can provide the best trainers or weapons money can buy.

In his book, Confessions of an Economic Hit Man, John Perkins pulls back the curtain to reveal how exactly the globalization machinery works. The people working behind the scenes do so mostly in secret and work for mostly boring names with lots of acronyms.

In an interview with monthlyreview.org, John Perkins said:

“They inhabit a stateless global archipelago of privilege — a collection of private schools, tax havens, and gated residential communities with little or no connection to the outside world. They are people to whom nations are as meaningless as they are to the global corporations and to the international aristocracy they serve.”

He went on to say: “The system of contemporary capitalist globalization operates for the exclusive benefit of a global plutocracy that has no national boundaries or loyalties. Oligarchy, (an interesting word that in western media is usually used as a propaganda technique to distinguish the “us vs them” paradigm), has been applied exclusively to the modern-day capitalist barons of Russia, is no less real in the triad of the United States, Japan, and Europe.”

Think of the Rockefeller family in America or the Rothschild family in Europe.

In fact, a Washington Times headline cited a Princeton university study in the headline — “America is an oligarchy, not a democracy or republic.” That article went on to note-“The U.S. government now represents the rich and powerful, not the average citizen.” The study concluded-“When a majority of citizens disagrees with economic elites and/or with organized interests, they generally lose.”

So, here is where the TTIP and the TTP come in. TTIP, which stands for Transatlantic Trade and Investment Partnership, or TTP, Trans-Pacific Partnership, are regional trade and investment treaties. This doesn’t sound too bad, right? Trade and business are, in theory, enough to bring countries together, thus preventing war. As a quick reminder, here are all of the countries involved so far —
TTIP covers: Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, United Kingdom.
However, to look at it another way, Wikipedia notes- “The United States and European Union together represent 60% of global GDP, 33% of world trade in goods and 42% of world trade in services. A free trade area between the two would represent potentially the largest regional free-trade agreement in history, covering 46% of world GDP.”

The Washington Post notes- “(Pacific Rim countries) are responsible for 40 percent of the world's GDP and 26 percent of the world's trade.  Putting this all together, one can clearly see that by passing these treaties, America becomes the center of the world, so to speak. So, what’s so wrong with that, some might say?

The problem is that the corporations don't represent the people. The interests of corporations and the little guy are often at odds with one another on many different levels. Corporations have gamed the system by using their deep pockets to donate large sums of money to politicians re-election campaigns to the use of lobbyists to sway votes in their favor. As proof of this, a recent story in the New York Times noted-“(the treaties) are a blatant attack on labor, farmers, food safety, public health and even national sovereignty.” But, how can that be?  Senator Charles E. Schumer of New York, the Senate’s No. 3 Democrat said- “This is really troubling,” It seems to indicate that savvy, deep-pocketed foreign conglomerates could challenge a broad range of laws we pass at every level of government, such as made-in-America laws or anti-tobacco laws.”

The New York Times continued by saying- “the public has no access to its contents, and even members of Congress don’t know much. (On the other hand, “cleared advisers,” mostly corporate lawyers, have full access.” See, that’s how they roll. Doing deals in the dead of the night, behind closed doors.

As further proof of the secrecy surrounding this deal,  United States Senator Ron Wyden wrote- “The majority of Congress is being kept in the dark as to the substance of the TPP negotiations, while representatives of U.S. corporations—like Halliburton, Chevron, PHRMA, Comcast, and the Motion Picture Association of America—are being consulted and made privy to details of the agreement. […] More than two months after receiving the proper security credentials, my staff is still barred from viewing the details of the proposals that USTR is advancing. We hear that the process by which TPP is being negotiated has been a model of transparency. I disagree with that statement.” Pretty amazing, right? Even a US Senator isn’t allowed to read some of the “finer print”.

We do know a little bit though. For instance, On March 26, 2015 WikiLeaks released the TPP's Investment Chapter, which noted- “the accord would grant the power to global corporations to sue governments in tribunals organized by the World Bank or the United Nations to obtain taxpayer compensation for loss of expected future profits due to government actions.”  Basically, corporations will be able to force anyone opposing them to do whatever they, in a backroom deal. The New York Times summed this up by writing- “The TPP is little more than enhanced corporation power branded as free trade. It gives corporations the right to challenge government regulations and seek compensation if they think they’ve been treated unfairly by any of the 12 Pacific Rim nations in the deal.”

The New York Times noted- “The agreement would even allow countries to challenge one another’s laws, so that “equivalency” may simply mean that the least powerful regulations become the norm. The United States would have no special standing: If our laws are seen as restraining trade or limiting profits, they could be challenged in special courts, per the TPP’s “investor state” clause. Philip Morris is suing Uruguay over that country’s antismoking laws under just such circumstances.”

As proof of just how bad the deal is for the little guy and how quickly politicians are working to pass it before people catch on to the scam, a bill was recently introduced that would give the US President Barak Obama “fast-track authority” regarding the TPP. If it passes, Congress could vote only up or down on the deal, not amend it. That means that it can’t be changed, only agreed upon or not. Which probably means that corporate lobbyists are working overtime now, in an attempt to line up the votes. If it was such a good deal for the people, why all of the secrecy? Why all of the need to rush it through Congress without an open debate?

To quote George Orwell’s 1984- “There will be no curiosity, no enjoyment of the process of life. All competing pleasures will be destroyed. But always — do not forget this, Winston — always there will be the intoxication of power, constantly increasing and constantly growing subtler. Always, at every moment, there will be the thrill of victory, the sensation of trampling on an enemy who is helpless. If you want a picture of the future, imagine a boot stamping on a human face — forever.” And that, dear listeners, is the future if these treaties are passed. Think of it like this- the entire world will be literally changed forever by the stroke of a pen if Obama signs the trade treaties. Corporations will win, and the little guy will lose, forever. With these treaties, the world is  moving towards the final stage of globalization — away from “democracy” to “corporatocracy”.

USA INC Predatory Government Betrayal - Deborah Tavares Dr Ed Spencer

May 15, 2014

A Predatory Government that is taking away the very soul of the people is what we now have. Incorporated... USA INC... unrepresentative Government....is what we really have and not a Government by the people. In this interview by Deborah Tavares she outlines our "Government" as grabbing more control but having less accountability. To object to this is Patriotic and she points out many of the problems and solutions.

For 100 years, the federal government has usurped powers not delegated to it in our Constitution. What should we do about it?

(this is a very well done and simple explanation of the predicament we are in, and really the ultimate answer to it  . .  many people, including me, realizes that so much/all of the laws, actions and beaurocracies being used against the people are unconstitutional . .  but do not really know "why" or "how" they are unconstitutional. . . . as well as the snakes everywhere who put themselves out there as "patriotic" and "conservative" on the radio, tv, etc, and get a following (Rush Limbaugh, Sean Hannity, Glen Beck, Mark Levine, etc, etc) that ultimately are working for the globalists, whether they realize it or not . . the answer is to NOT CHANGE the Constitution, but to enforce it . . which would eliminate practically ALL of the tyranny . .  simple, but very, very difficult . . . )

MARK LEVIN'S "LIBERTY" AMENDMENTS: LEGALIZING TYRANNY

By Publius Huldah
April
19, 2014
NewsWithViews.com

For 100 years, the federal government has usurped powers not delegated to it in our Constitution.

What should we do about it? Should we reclaim our existing Constitution and put an end to the usurpations?

Or should we “modernize”the Constitution by delegating to the federal government the powers it has usurped – so as to legalize what is now unconstitutional?

Mark Levin begins “The Liberty Amendments” by saying he doesn’t believe the Constitution requires “modernization through amendments”. But he then proposes a series of amendments, six of which modernize our Constitution to delegate to the federal government most of the powers it has usurped during the last 100 years.

And each of his six amendments does the opposite of what its title promises .I’ll show you.[1]
Levin’s amendment to “limit the federal bureaucracy” [p 99-100 of his book]
George Washington’s cabinet had four members: Secretary of State, Secretary of War, Secretary of the Treasury, and Attorney General. Those functions are authorized by our Constitution.[2]

But today there are numerous agencies in the Executive Branch of the federal government. Where is the constitutional authority? What Article, Section, and Clause authorizes the Departments of Agriculture, Education, Energy, Labor, Transportation, HHS, HUD, DHS, EPA, SBA, etc., etc., etc.?

There is no constitutional authority! Accordingly, all these agencies are unconstitutional as outside the scope of the powers delegated in our Constitution.

Well then, a person who wanted to “limit the federal bureaucracy” would demand that these agencies be closed, and their functions returned to the States and The People, right?
But Mark Levin doesn’t do this. Section1 of his amendment legalizes all these agencies. It says:
“All federal departments and agencies shall expire if said departments and agencies are not individually reauthorized in stand-alone reauthorization bills every three years by a majority vote of the House of Representatives and the Senate.”
As long as Congress periodically “reauthorizes” the agencies– they remain.
Levin’s amendment thus changes the constitutional standard for whether an executive agency lawfully exists from whether it carries out an enumerated power [as in Washington’s Cabinet] to whatever the President wants and Congress agrees to. Do you see?

Now look at Section 2 of Levin’s amendment to “limit the federal bureaucracy.” It says:
“All Executive Branch regulations exceeding an economic burden of $100 million, as determined jointly by the Government Accountability Office and the Congressional Budget Office, shall be submitted to a permanent Joint Committee of Congress, hereafter the Congressional Delegation Oversight Committee, for review and approval prior to their implementation.”
Article I, §1, of our Constitution says only Congress may make laws.[3] But since Woodrow Wilson, executive agencies in the federal government have been churning out regulations which govern all aspects of our lives. These comprise the now gigantic Code of Federal Regulations.

All these regulations are unconstitutional as in violation of Art. I, §1![4]

Well then, one would expect that a person who wanted to “limit the federal bureaucracy” would demand the repeal of existing regulation sand an end to all future rulemaking, right?
Not Levin!Section2 of his amendment legalizes all existing regulations and the rule making process. Levin’s “fix” is merely to form a congressional committee to review certain regulations before they are imposed on the American People.

And so,federal executive agencies will continue to churn out millions of pages of regulations – but now, they will be constitutional because Levin’s amendment makes it all lawful.

Do you see? Levin’s amendment legalizes the status quo and does the opposite of what he claims.

Levin’s amendment “to limit federal spending”(p 73 -74)

Our Constitution limits federal spending to the enumerated powers. If you go through the Constitution and highlight the powers delegated to Congress or the President, you will have a complete list of the objects on which Congress may lawfully spend money. That is how our Framers controlled federal spending. It is the enumerated powers which limit spending – not the amount of revenue the federal government generates or the size of the GDP.Do you see?

The reason we have a crushing debt is because for 100 years, the federal government has ignored the limits –already set forth in the Constitution - on its spending.

Well then, a person who wanted to “limit federal spending” would demand that Congress begin to downsize the federal government and restrict spending to the enumerated powers, right?

But Levin doesn’t do this. Section 1 of his amendment legalizes all the spending which is now unconstitutional as outside the enumerated powers. It says:
“Congress shall adopt a preliminary fiscal year budget no later than the first Monday in May for the following fiscal year, and submit said budget to the President for consideration.”
Levin’s amendment thus legalizes the unconstitutional status quo where the President and Congress adopt a “budget” and spend money on whatever they put in the budget! Levin would permit Congress and the President to lawfully spend money on whatever they want – spending which is now unlawful because our Constitution doesn’t authorize it.

Furthermore, Levin’s amendment does nothing to control federal spending. While Sections 3 & 4 of his amendment pretend to limit spending to revenues or to a percentage of the GDP; Sections6 & 7 permit Congress to suspend the spending limit and continue to raise the national debt.[5]

Levin’s amendment “to limit federal taxing” (p 75)

Our Constitution doesn’t permit the federal government to levy taxes so that Congress and the President will have the funds to spend on whatever they want.

Congress may lawfully levy taxes only to raise the funds to carry out the enumerated powers. Article I, §8, clauses 1 & 2 say:
“The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common defense and general Welfare of the United States …” [and] “To borrow Money on the credit of the United States;”
Immediately after clauses 1 & 2 follows the list of enumerated powers we delegated to Congress for the Country at Large.[6]

Add to this short list of enumerated powers, the “housekeeping powers” itemized elsewhere in the Constitution (e.g., the census); the salaries authorized by Art. I, §6, cl. 1; Art.II, §1, next to last clause; Art. III, §1, cl. 1, and others on the civil list; and you see the purposes for which Congress is authorized to levy and collect taxes, borrow money, and spend money, for the Country at Large.[7]

So! Congress should not be levying taxes except to generate revenue for its constitutional functions. If Congress restricted its spending to those few powers delegated in the Constitution, the federal government would need very little money from us.
One would expect that a person who wants to“limit federal taxation” would demand that the federal government stop taxing to raise money to spend on unconstitutional purposes, right?
Not Levin! While his amendment limits the federal income tax to 15% of income – it institutionalizes the present practice where Congress lays & collects taxes for any purposes whatsoever.[8]

Levin’s amendment “to protect private property” (p 137)

The federal government has no lawful authority to own land for any purpose other than those enumerated in the Constitution: Article I, §8, next to last clause, permits the federal government to own the District of Columbia [which was not to exceed “ten Miles square”], and Places purchased with the Consent of the State legislatures for the erection of forts, dock-Yards, and other needful buildings (e.g., federal courthouses, post offices) to carry out the enumerated powers.

The federal government has no lawful authority to own national parks, grazing areas, forests, and such.[9]

And the federal government has no lawful authority to restrict peoples’ use of their own land. Now here in our Constitution did we delegate that power to the federal government! Accordingly, all federal laws and regulations (EPA,etc.) which pretend to restrict an owner’s use of his land are unconstitutional as outside the scope of powers delegated.

Furthermore, the States’ and local governments’ powers of eminent domain and other “takings” of private land are addressed in their own State Constitutions and laws. This is NOT a federal issue!

But Levin’s amendment “to protect private property” changes all of the above. It says:
“When any governmental entity acts not to secure a private property right against actions that injure property owners, but to take property for a public use from a property owner by actual seizure or through regulation, which taking results in a market value reduction of the property, interference with the use of the property, or a financial loss to the property owner exceeding $10,000, the government shall compensate fully said property owner for such losses.”
Levin’s amendment:
Changes the constitutional standard for federal ownership of lands from carrying out an enumerated power to what ever someone in the federal government deems a “public use” [which can be anything];

Legalizes what are now unconstitutional holdings of lands by the federal government – such as grazing lands;

Legalizes “takings” by regulation – restrictions via regulations on the use of private lands - by all levels of government;

Takes from the States and The People their retained powers over eminent domain and regulatory takings, and makes it a federal issue under the control of the federal government;[10] and

Provides that as long as a taking does not reduce the value of the property by more than $10,000, the governments don’t have to pay the property owner one red cent. So! If your local or State or federal government takes some of your land, or restrict its use by regulation,Levin’s amendment requires compensation to be paid if the “taking” exceeds $10,000. If the government decides that your loss is less than $10,000, you eat the loss. The amendment legalizes government theft of private property.

Levin’s amendment “to protect the vote” (p 183-184)

Before our Constitution was ratified, the States qualified & registered voters. Qualifications were set forth in their State Constitutions, and requirements differed from State to State. This power was expressly retained by the States with Art. I, §2, cl. 1, U.S. Constitution.[11]

The four voting amendments reduced this retained power of the States, and delegated to the federal government power to stop States from denying suffrage to citizens on account of race (15th Amendment), sex (19th Amendment), failure to pay a tax (24th Amendment), or age for citizens eighteen years of age or older (26th Amendment).

Except as restricted by these four amendments, the States retain their pre-existing power to set qualifications for registering citizens to vote, as long as they do not deny it on account of race, sex, failure to pay a tax, or age for those 18 years or more. States remain free to deny registration on other grounds – such as conviction of a felony or illiteracy. And of course, States retained power to restrict voting to citizens!

But the retained powers of the States to set voter qualifications for registration were diminished far beyond the scope of the amendments, due to usurpations by the federal government, and because the States forgot that they retained at Art. I, §2, cl. 1 most of their original power to qualify & register voters.

In Arizona’s Proposition 200: What The Constitution Really Says About Voter Qualifications & Exposing The “Elections Clause” Argument, I show how the federal government infringed upon the States’ retained powers over voter qualifications & registration; and how the two judges in that case wrongly ruled that Arizona could not require applicants for registration to provide proof of citizenship!

So! What should we do about non-citizens voting? Here is a novel idea: The States should man up and reclaim their powers retained by Art. I, §2, cl. 1; tell Eric Holder to take a hike; require all currently registered voters to provide proof of citizenship; and refuse to register new voters unless they provide proof of citizenship. Enforce the Constitution we have!

But Section 1 of Levin’s amendment “to protect the vote” says:
“Citizens in every state, territory, and the District of Columbia shall produce valid photographic identification documents demonstrating evidence of their citizenship, issued by the state government for the state in which the voter resides, as a requirement for registering to vote and voting in any primary or general election for President, Vice President, and members of Congress.”
Levin’s amendment (it has 5 Sections) rewards the federal government for unlawfully forbidding States from requiring applicants to prove they are citizens, by transferring more power over voter qualifications & registration to the federal government.[10]

But Levin’s amendment does even more harm than vesting in the federal government a power it already usurped - it ushers in a national ID card. Who thinks the feds won’t dictate the contents of the card and keep copies? [Do you really think a national ID card is a great idea?]

To add insult to injury, Levin’s amendment doesn’t even prohibit non-citizens from voting – it merely requires citizens to get an ID card before they can register to vote. Non-citizens are not required to get ID cards. The supreme Court (which will now lawfully have judicial power over this issue) will decide whether aliens can vote.

Levin’s amendment “to promote free enterprise” (p 117)

In Federalist No. 22 (4th para) and Federalist No. 42 (11th&12th paras), Hamilton & Madison explain the original intent of the “interstate commerce” clause: It is to prohibit States from imposing tolls &tariffs on articles of merchandize as they are transported through the States for purposes of buying and selling. Until the mid-1930’s, this was widely understood. Here is a full proof of the original intent of that clause and the story of how the supreme Court usurped power over interstate commerce.

The original intent of that clause is still the supreme Law of the Land![12] So the States must man up and enforce that original intent. They must ignore - nullify - all pretended federal laws, regulations, and judicial opinions which are contrary to that original intent.

Levin’s amendment “to promote free enterprise” says:
“SECTION 1: Congress’ power to regulate Commerce is not a plenary grant of power to the federal government to regulate and control economic activity but a specific grant of power limited to preventing states from impeding commerce and trade between and among the several states.”
“SECTION 2: Congress’s power to regulate Commerce does not extend to activity within a state, whether or not it affects interstate commerce; nor does it extend to compelling an individual or entity to participate in commerce or trade.”
Section 1 broadens the powers of the federal government from prohibiting States from imposing tolls &tariffs on articles of merchandize as they are transported through the States for purposes of buying and selling, to prohibiting the States from doing anything which “impedes” commerce and trade between and among the States.

Many things can be said to “impede” commerce and trade. And who will decide what “impedes” and what doesn’t “impede”? Five judges on the supreme Court.

Section 2 mentions two instances where Congress’ power to regulate Commerce does not extend. This is dangerous because of the legal maxim, Expressio Unius Est Exclusio Alterius (the expression of one thing is the exclusion of the other).

Accordingly, Congress’ power to regulate commerce would extend to other instances. Which ones? We don’t know - the supreme Court will decide – on a case by case basis.

Conclusion

Levin’s amendments legalize - make constitutional - the very abuses they purport to correct, nullify the natural rights of the people, and fundamentally change the constitutional design.

Even though our Constitution is not being enforced, it still declares this federal government lawless! The true rule of law is still on our side, but not for much longer if we foolishly allow our Constitution to be re-written.

Endnotes:
1. Telling the Truth about a person’s proposals isn’t “demonizing” him. People angrily reject valid criticism of Levin’s proposals because they have made an idol of him. If their loyalty were to Truth - instead of to their idol - they would want to be set straight.
2. Article II, §2, and:
Secretary of State: Art. I, §8, cl. 3
Secretary of Treasury: Art. I, §2, cl.3; Art.I, §8, cl. 1; Art.I, §9, cl.4-7; Art. VI, cl. 1
Secretary of War: Art. I, §8, clauses 11-14
Attorney General: Art. I, §8, cl. 6, 10&17; Art.III, §§2&3; Art. IV, §2, cl.2
3. Article I, §1, says: “All legislative Powers herein granted shall be vested in a Congress of the United States…” [emphasis mine]
4. They are also unconstitutional as outside the scope of powers delegated to the federal government.
5. I explain the problems with “balanced budget” amendments here.
6. These are the enumerated powers over the Country at Large listed at Art. I, §8:
• Clause 3: regulate “commerce” [For the Truth about the “commerce clause”, go here];
• Clause 4: uniform laws on naturalization and bankruptcies;
• Clause 5: coin money & regulate its value, and fix standard of weights & measures;
• Clause 6: punish counterfeiting;
• Clause 7: establish post offices & post roads;
• Clause 8: issue patents ©rights;
• Clause 9: set up federal courts inferior to the supreme court;
• Clause 10: punish piracies & felonies on the high seas and offenses against the Law of Nations;
• Clauses 11-14: war, letters of marque & reprisal, Army & Navy, and rules for the military
• Clause 15-16: the Militia.

7. The anti-federalists objected to Art. I, §8, cl. 1 & 2. They claimed:
“…the power ‘to lay and collect taxes, duties, imposts, and excises, to pay the debts, and provide for the common defense and general welfare of the United States,’ amounts to an unlimited commission to exercise every power which may be alleged to be necessary for the common defense or general welfare.”
James Madison answered in Federalist No. 41 (last 4 paras) that clauses 1 & 2 permit Congress to levy taxes & borrow money only to carry out the enumerated powers! Madison said:
“Had no other enumeration or definition of the powers of the Congress been found in the Constitution, than the general expressions just cited, the authors of the objection might have had some color for it…But what color can the objection have, when a specification of the objects alluded to by these general terms immediately follows, and is not even separated by a longer pause than a semicolon? … Nothing is more natural nor common than first to use a general phrase, and then to explain and qualify it by a recital of particulars. But the idea of an enumeration of particulars which neither explain nor qualify the general meaning … is an absurdity…” [boldface mine]
So!Article I, §8, cl.1 is merely a “general expression,” the meaning of which is “ascertained and limited” by the clauses which “immediately follow” it.In other words, clauses 1 & 2 grant to Congress the power to raise money; and clauses 3-16 enumerate the objects on which Congress may appropriate the money so raised, thus limiting clauses 1 & 2. Do you see?

8. Levin’s amendment also corrects – on behalf of the feds - the following: When the 16th Amendment was ratified, “income” apparently didn’t include “wages.” Accordingly, it would be unconstitutional to force people to pay “income” taxes on “wages” - and such would thus be a proper object of nullification by States. But Levin’s amendment legalizes the status quo and rips this remedy from the States.
9. When our Constitution was ratified, the new federal government acquired (from its predecessor) the Western Territory (Federalist No. 7, 2nd & 3rd paras, and Federalist No. 43 at 5.) over which the new federal government was delegated, by Art. IV, §3, general legislative powers. As the Territory was broken up into new States, the general legislative powers would expire and sovereignty [except as to the few powers delegated exclusively to the new federal government] would be transferred to the new State.
10. Amendments to the Constitution generally increase the powers of the federal government: They usher in implementing federal statutes & executive agency regulations, and judicial power over the issue is transferred to the federal courts. Art III, §2, cl.1, says, “The judicial Power shall extend to all Cases … arising under this Constitution …” Do you really not see?
11. Article I, §2, cl. 1, says:
“The House of Representatives shall be composed of members chosen every second Year by the People of the several States, and the Electors in each State shall have the Qualifications requisite for Electors of the most numerous Branch of the State Legislature.” [boldface mine]
So! Whoever votes in elections for their State House, is eligible to vote for members of the federal House of Representatives. See also Federalist No. 57 (5th para) & Federalist No. 52 (2nd para).

12. Article VI, cl. 2, the “supremacy clause”, states that only our Constitution, federal laws made “in Pursuance” of the Constitution, and Treaties made “under the Authority of the United States”, shall be the supreme Law of the Land. Supreme Court opinions are NEVER part of the supreme Law of the Land! But we have wrongly made them the only Law of our Land.

The Bankruptcy of America – 1933

[The following is excerpted from Judge Dale's The Great American Adventure - Secrets of America.]
By Judge Dale, retired
our corrupt legal system_2
Public Trust

On March 9, 1933, House Joint Resolution No. 192-10 by the 73rd Congress, was voted into law, which is the Emergency Banking Act.  This Act declared the Treasury of the United States, ‘Bankrupt’, which is an impossible feat since the U. S. Treasury was secretly closed by the Congress twelve years earlier in 1921.  The Emergency Banking Act succeeded in abrogating America’s gold standard and hypothecated all property found within the United States to the Board of Governors of the Federal Reserve Bank.

All Sovereign American Citizens residing within the Republic of States suddenly and falsely were expatriated from their Sovereign American status without their knowledge or consent and their labor, souls, children, property, sweat equity and credit became the financial collateral for the public debt, which had then been converted into a Public Trust, which had been scripted after the ancient Roman Trusts.

“Script” money or [negotiable debt instruments] was issued by a private corporation, which is owned by a group of Sabbatean European Jewish Bankers and which is known to everybody as: “The Federal Reserve System.” These promissory notes were called Federal Reserve Notes and our future treatment by the U.S. Government was to be redefined under USC Title 50, ‘The Trading with the Enemy Act’ in which American citizens are defined as, “an enemy of their government” and this is the reason why Lincoln’s Declaration of War is renewed yearly by Congress and the President!  In the same year President Roosevelt closed THE VIRGINIA COLONY CORPORATION and opened a new Government Corporation called: THE UNITED STATES, INC.

“The Federal Reserve Act” was designed and written by a German National who was repatriated into the United States in 1903 through Ellis Island of New York.  His name was Paul Warburg, and who was a carbon copy of Alexander [Levine] Hamilton.  Mr. Warburg was a Sabbatean German Jewish Banker and CFO of the Rothschild Banking Empire.  Mr. Warburg’s assignment was to craft a piece of legislation designed to control the finances of the United States Corporation from Europe.  The Federal Reserve Act is approximately 1500 pages and places the currency and finance for the United States Corporation under a private corporation called, “The Federal Reserve.”  The Federal Reserve is owned lock, stock and barrel, by the Sabbatean/Rothschild Banking Empire and not by the people or the corporate government of the United States.

The Great Depression of 1929, like so many other catastrophes before and after this date was actually a staged event, concocted by the Sabbatean/Rothschild and Rockefeller Banking Empires; the Queen and British Parliament; the US President and Congress; the Vatican and numerous Elite families to steal America’s gold and silver reserves and replace it with, “Negotiable Debt Instruments” or Script money.  Their theft was ingenious and by allowing the public to fall on hard times, the public soon began to demand that the government fix the problem by any means necessary!

This was like self mutilation being repaired with a band-aid!

NOTE:  While everyone struggled in this Country to survive, President Roosevelt and the Congress were making interest bearing loans to Foreign Governments, using the very money they publicly swore did not exist!  Germany used that money to enlarge their War Chest.  The American public however was so self-indulged about their own personal fate that they never considered or asked how it was possible that all of the above government individuals, never personally lost a dime during the Great Depression and how they all continued to enjoy their family estates and personal wealth!  Remember the term, “functional illiterates?”  Need I say more?

We all have been trained to believe that someone not born on American soil is an alien however we forget to consider that the Declaration of Independence was written completely by aliens and not one adult Colonist or Founding Father was born on American soil!  The Immigration Laws of the United States are contrary to the Declaration of Independence and the biggest Terrorist on the planet is now the United States Government!  This fact will be further discussed later on.

Following the 1933 bankruptcy; most American’s were not aware that HR 1491 or HR 4960 had been secretly passed, wherein the US Congress actually relinquished our right to have or accumulate gold and silver.  The Congress eventually repealed part of this legislation to accommodate jewelers but all Americans’ are still prohibited from having or accumulating solid gold and silver.  Hence, our coins are no longer solid gold or silver but are tin and nickel plated, carbon filled coins.  Pennies are tin and copper plated carbon filled coins.  These Acts also established the requirement of licensing and then with the enactment of ‘The Trading with the Enemy Act’ under War and National Defense; the Confiscation Act, the Reconstruction Act and the Lieber Code were all tied together to create the secret fascist government of the United States.

NOTE: The word ‘license’ is defined in all modern law dictionaries as:  “A permit to do something unlawful.”  Now think about that and consider all the Licenses you currently hold?  Those licenses are civil contracts that have been issued to you by the government only so that you may do something lawful but rather unlawful!

[e.g.]  When two people apply for a marriage license, the two of you enter into a binding contract and by applying for a license to marry, you now have voluntarily included the State as a third party to your marriage!  If things don’t work out in that marriage, the State is first to be satisfied.

[e.g.] Your right to travel is an unalienable right defined by the Declaration of Independence and not a privilege and yet the government demands that you apply for a driver’s license!  Google: Right to travel and read the millions of old Court rulings that cite our right to travel without a license!  PS/ The Courts now refuse to honor those old precedents of law since 1938 because of a Supreme Court case titled:  Erie Railroad v. Tompkins, 304 US 64 (1938).

Mr. Tompkins attempted to walk along a set of Railroad Tracks when he was struck by an appendage fastened to a mail train and he subsequently sued claiming negligence and damages on the part of the Railroad.  What Tompkins didn’t know was that the Railroads were in partnership with the Corporate United States Government and so to protect the Government, the Supreme Court ruled that: ‘Absent a ticket or license, Tompkins was trespassing on railroad property and therefore he was barred from any relief.’

This ruling wiped the slate clean by eliminating all previous Court precedents that occurred prior to the year 1938 concerning our unalienable right to travel and opened a floodgate for new State and Federal Government controls such as: The State Vehicle Codes and the requirement for licensing of everything and anything!

Prior to 1933, we all were proud and peaceful Sovereign inhabitants of America. The Trading with the Enemy Act, the Confiscation Act and the Lieber Code obligated the military government to, ‘peacefully interact with American citizens’ and prohibited them from ‘provoking us or to act belligerently toward us’ [or] they forfeit their ability to profit and loot [or] to securitize our property, equity and credit being held in a Public Trust.

From Silent Weapons for Quiet Wars (pg 9)
“War is therefore the balancing of the system by killing the true creditors (the public which we have taught to exchange true value for inflated currency) and falling back on whatever is left of the resources of nature and regeneration of those resources.”
_____________________________________________________

When we voluntarily or involuntarily entered their Military Courts of Justice, one will frequently hear the prosecutor or defense lawyer argue that: ‘Your comment or actions are a belligerent response’ [or] ‘You are being combative.’  Key words to inform you that you or someone else, is about to be fleeced!  Lawyers will even attempt to provoke you or your witness’s anger in the Court, just so you or they behave belligerently toward them and this is why they do that!

Under Regulation 840-10 of the Military Code and sections of the Administrative Procedures Act and the presence of that Military [gold fringed] Flag on display in the Courtroom, instantly creates a state of emergency meaning that, the moment a police officer stopped you in the exercise of your right to life, liberty and the pursuit of happiness, the police officer became a belligerent!  He is armed and you’re not!  He displays a military rank and you’re a civilian and he has now delivered you into a Military Court of Justice with the intent to ‘pillage and plunder’ within the Admiralty jurisdiction of that Military Court, which is also known as ‘The Law of Prize and Captured Property,’ as defined under Title 10, sections 7651 to 7681 of the Code of Military Justice, March 25, 1862.

As mentioned before, The Reconstruction Act included and changed all state officials into having ‘federal foreign standing.’ The 14th amendment deliberately forced and kept them there and section 2 of the Lieber Code instructs that: ‘A victorious army seizes all money and movable property and holds it in trust,’ and this is exactly what the Corporate United States Government and State Governments did and continue to do because they now perceive themselves to be, ‘a victorious army.’

The corporate Congress; the corporate Military Government and their corporate Military Courts of Justice however discovered that they could not gain access to those Public Trusts deposited into the Federal Reserve System, which they had created using our birth registration forms; social security registration forms, licenses, personal property, deeds, promissory notes, equity and credit, without including our individual persons into the bankruptcy of the United States Treasury of 1933.  So they cleverly denied our personal Sovereignty and converted our persons into an appellation, which is a corporate fiction or strawman and identified us by writing our birth names all in capital letters.  All of our Licenses and documents now reflect this appellation.

NOTE: Of course they cannot lawfully do this because we are a Sovereign people and they are a Corporation and under the Confiscation Act, they have violated their own, ‘Rules of Engagement and Military Protocol’ but do they care?  Not any more!

The all-caps name can be researched in every State Code under ‘corporations:’ [e.g.] see the Texas Administrative Code for example under ‘corporations’, Chapter 79.31, subtitled: entities; [also] the all-caps name is specified in the United States Government- Style Manual under the section titled [identifying corporations].

These Public Trusts are not a new concept.  The concept and strategy was copied from the Ancient Roman Empire and their use of Roman Trusts.  The Ancient Roman Trusts declared that everyone had died after Rome was burned [which was a staged event] and until those Roman Citizens served notice upon the Roman Senate that they were in fact alive and capable of managing their own Estates, all were presumed dead and the Roman Senate became the Trustee over every Estate and used them as they deemed appropriate!

In 1932 the US Government did the same thing. After the banking cartel orchestrated the Great Depression, poverty gripped a huge percentage of the population. Most Americans are unaware that the ‘government’ helped destroy food while the people were suffering from mass starvation. Russian researchers have exposed this tragedy and named it the Great American Holomodor.

NOTE:  You can buy your freedom for a price of $600,000 dollars through the Department of State, which is the cost of procuring American diplomatic immunity pursuant to International Law.  In all other countries this same immunity can be purchased for $95,000.00, which is honored in 90 of the 267 world countries with the exception of: The United States, Canada and the United Kingdom.  [Isn’t that curious?]  My point here is that everything is a game and for enough money, anyone can play and secure their freedom from criminal law, civil lawsuits, taxes and passports because everything in this world is about commerce.

In 1933, this corporate government enticed Americans to voluntarily register for birth certificates, social security, driver’s licenses, voter registration, etc. and enticed us with government benefits to do so.  Years later they obligated American’s to register for all of these documents except for voter registration.

These so-called government benefits were no bargain because they belonged to all of us to begin with and over time the largest benefits have been watered down!  What most American’s don’t realize is that: No Corporation can operate or fund itself. Corporations require human beings; their credit and sweat equity to finance and operate them!  Therefore, everything that the government claims to own actually belongs to “We the Public” and not them!  Everything they have been doing is one gigantic fraud and all of it at our expense!

As previously mentioned: These registration programs were instituted so that the Federal Reserve Banks and the Corporate Military Courts of Justice could securitize and monetize the public Trust Accounts.  Each Birth Certificate and Social Security Card was eventually converted into a Trust Account and became a government security [like company stocks and bonds] and is marketed as a Mutual Fund.  If you own a piece of a Mutual Fund Investment you are actually hedging your money against human collateral.

Every Bond or International Security is assigned a “CUSIP” number and if you know how to use their formula or have a close friend who is a stock broker, you or he can convert the numbers and letters found on your Social Security Card into its CUSIP number. Armed with those CUSIP numbers, anyone can look up their Mutual Funds that your life is being collectively marketed under.  Your Birth Certificate number is handled the same way.

Our forced registration [birth] actually made us the personal property of the State.  Each of us unknowingly gave our children away to the Government of the State where they were born when we registered them for a government issued Birth Certificate, which is how the State Government controls child custody!  Our children are now their collective property and we are permitted to keep and raise them, providing that we behave ourselves and comply with their corporate laws and regulations!

The State obligates us to pay for our children and they generally object to pay for anything unless we become dead or destitute!  It is also the Birth Certificate that provides the Police with the authority to break and enter any house under suspicion of abuse but now the Patriot Act covers all other situations.  The Fee Simple Deed gave the State your home and the right to tax you into poverty as a Tenant and the Patriot Act eliminated the need for search warrants.

You are no longer the King of your castle, which was guaranteed by the Allodial Deed because you no longer own a castle!  Your personal Lawyer set that one up too and received a large, one time secret kickback, from the State Government on your first tax bill in addition to the fees you paid to him to represent your best interests!  Devious people, aren’t they?

When our deeds were Allodial, no one could trespass on our property, not even the government.  No one could Tax your property and no Bank could foreclose on your property but there again, no Bank would ever loan you money against your property either! We were the Kings and Sovereign Rulers of our land and homes.  Do you now see how the government has been chipping away at your basic rights and freedoms?
